Change is coming- either influence it or don’t complain.
The proposed changes to the rules of bankruptcy procedure and to the official forms have been published and your comments are solicited.
The comment period will remain open til February 15, 2014. There’s no reason to wait til the last minute to be heard, however.
I have been told repeatedly by many of those involved that each and every comment is read and considered.
Chapter 13 plan
Included in the form changes is a Chapter 13 plan form. Judge Wedoff’s submittal to the Judicial Conference contends that a national plan form will bring uniformity to Chapter 13 practice and simplify the review of plans by debtors, creditors, courts, trustees and creditors.
Take a look at the proposed chapter 13 plan and see what you think.
Then be heard. Now, while it matters.
I’m interested in your assessment of how much additional time will be required to draft a plan using this form.
Can you articulate circumstances in which your review of the plan will be “simplified”?
